I agree that end-user understanding of the technology is a problem, but IMO criminal law is not a solution here. Especially since a person can connect to an AP that is not their own without even intending to do so. In theory the court should weigh the infringing user's intent, but since justice is a human institution, subjective judgements increase the probability that injustice will be done.

Simply disabling SSID and giving the AP a unique name, a process which could be made very simple and straightforward so that a majority of end-users could understand it, would prevent the AP from handing an IP to any laptop in range. Problem with that is that people also want convenience, and since this adds one more configuration step on the side of the system(s) that are intended to connect to the AP.

Maybe the equipment needs to be sold as matched sets with unique identifiers, or selectable coding switches like those which garage door openers have...
