The way I see it, if you were broadcasting a personal FM transmitter and it was broadcasting widely enough that somebody off your property could tune into it...it would be no different. Whether or not you intended to do so, you have openly offered a public broadcast and can hardly fault another party for listening (at least, not in terms of criminal law).

It would be one thing if you had put basic security your wireless AP and somebody then deliberately broke into it, which would be like tapping into the cable, but if you're broadcasting an SSID from an open AP with DHCP enabled (pretty much the out-of-box default for most wireless APs), the AP automatically invites and synchs up any wireless users in the area. That's hardly a theft IMO.
