If you burn up the CPU by removing the heatsink, there will be obvious signs indicating this. First of all, the heatsink would show no visible signs of burning, which would naturally happen if it was attached to the CPU when it burned up.

My advice: try the warranty. If it doesn't work out for you, lesson learned. You find a new vendor, or buy AMD. No need to be dishonest in the deal.
