You maybe safe with out the files but if all you need is gif file why are you worried about a empty file ?.
It sounds like this CD has a mistake or this is some form of old copy protection.

If you want a good copy of this CD then why not use a CD Burner & use a program like CloneCD ?.

If you are using windows to copy the files & your CD has hidden files & you will not make a copy of them.
